1. Owners: It is understood that 1236 Kiawah Beach Drive is owned by Roland and Renee Webb including the linen and furnishings. The Guest(s) agrees to compensate the Owner for any damages caused by their carelessness or negligence including missing or ruined linen.
2. Reservation: A deposit of $300 is required to confirm a reservation, and payment must be received within 10 days of making the reservation. Reservations are automatically cancelled if a deposit is not received within 10 days. In addition to the listed rental rates, local and state sales and ATAX, and $100.00 security will be added. Taxes are subject to change without notice. The balance of the rental is due 30 days before check-in. A bill or reminder is not sent out for final balance. Payments made after the 30 days must be in the form of a cashier’s check, money order, or certified check. Credit cards are not accepted. All deposits from Canada must be in U.S. Funds payable by money order of cashier’s check only. Personal checks from Canada are not accepted. A $25.00 handling fee will be added to Guest’s balance for each returned check.
3. Cancellation: If you have to cancel or change a reservation, please notify as soon as possible. Every effort to re-rent the week will be made. If the week is not re-rented, your monies will not be refunded. A $25.00 cancellation fee will be charged if you wish to change the reservation to another available week. If the week is cancelled and re-rented, your monies will be returned less a $25.00 cancellation fee.
4. Security Deposit of $100.00: Damage and breakage caused by a previous guest should be reported upon check-in. For a full refund of security deposit, the cottage must be left damage free, and guests must be checked out by 11 a.m. The Security Deposit will be refunded by mail within 45 days without interest after a satisfactory inspection.
5. Pets are not permitted under any circumstances!
6. Check in: Guest(s) acknowledges and understands time to be NO EARLIER THAN 4:00 p.m.
7. Check out: Guest(s) acknowledges and understands time to be NO LATER THAN 10:00 a.m.
8. Telephone Calls: Guest(s) agree not to charge long distance calls or operator assisted calls (i.e. directory assistance, repeat call, etc.) on the Owners Telephone. All long distance calls must be collect, credit card, or third party calls. Any charges made by the guest to the Owners Telephone will incur an additional $10.00 service fee added to calls charged to telephone. Internet access must use a local telephone number in Band A and if local service allotment is exhausted, excess will be charged to the Guest(s)
9. Occupancy and use of premises & communal areas: Shall not be such as to disturb or offend Residents. Guests may not hang towels, garments, etc. from windows, balconies, etc. Bikes are not to be left on lawn, driveway or street, etc. Guests shall not cause noise disturbance, etc.
10. Parking: No power vehicle of any kind may be driven on the beach. No boats, trailers, RV’s, etc. or more than 2 cars "PIGGY-BACK" will be parked in the driveway of the property. Street parking is not allowed.
11. Keys: The Guest(s) further agrees to return the property's keys to key holder on laundry room wall and to leave lock box key on front door, intact.
12. Maximum Number of Occupants: no more than four (4) persons.
VIOLATION OF THIS PROVISION SUBJECTS GUEST(S) TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE OWNER BECAUSE OF THE FACT THAT THIS GUEST LICENSE AGREEMENT IS A SHORT TERM VACATION RENTAL. PENALTY FOR VIOLATING MAXIMUM OCCUPANCY CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER SYSTEM ON THE PREMISES. IN THE EVENT OWNER ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN FOUR PERSONS, GUEST(S) SHALL BE RESPONSIBLE TO PAY OWNER THE SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON, IN EXCESS OF FOUR PERSONS PER DAY, FOR EACH DAY PREMISES ARE TO BE OCCUPIED BY MORE THAN FOUR PERSONS.
13. Permitted Occupants: Responsible Guest is to be at least 21 years old and a family group. No fraternities, school, civic or other non-family groups are allowed unless prior approval is granted by the owner. Guest misrepresenting their group or exceeding maximum occupancy will be subject to expedited eviction without a refund.
14. Mandatory Evacuation: If State or local authorities order a mandatory evacuation of Kiawah Island, Guest(s) shall comply with evacuation order. Guest may purchase vacation rental insurance through http://insuremytrip.com . In the event of an evacuation, the Guest shall not be entitled to a refund regardless of whether the Guest did or did not purchase vacation Rental insurance.
15. Guest(s) agree that any guest who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
16. Guest(s) and/or their guests agree that during the term of this Guest License Agreement and such further time as he/she occupies the premises, he/she will keep the premises clean, free of trash, garbage, and other waste; clean spills, after cooking in the kitchen, or food spilled in other areas of premises. All pipes, wires, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the Guest License Agreement, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
17. Guest(s) agree to indemnify and save Owner harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the premises by the Guest(s) and/or their Guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises.
18. Guest(s) agree that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the Owner’s written consent.
19. Guest(s) may not let, sublet or assign this Guest License Agreement for all or any part of the premises without prior consent of the Owner.
20. Guest(s) assumes full responsibility for fulfilling the terms of the Guest License Agreement for the period stated and assure the Owner full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the Guest(s).
21. In the event that any action shall be commenced by either party arising out of, or concerning this Guest License Agreement or any right or obligation derived therefore, the prevailing party shall be entitled to receive attorney’s fees as fixed by the Court in addition to all relief at law or equity.
22. Either party may terminate this Guest License Agreement in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
23. THE OWNERS OR THEIR AGENTS HAVE THE RIGHT TO TERMINATE THIS AGREEMENT AND EVICT ANY DISRUPTIVE GUEST(S).
24. The Owners, or their Agents, are not responsible for articles lost, stolen or left behind in the Property.
25. Guest(s) agree that the Owners or their Agents may enter the premises for the purposes of effecting necessary repairs and/or maintenance or for any other necessary purposes, including inspection.
26. The Guest(s) acknowledge and understands that he (she) is a licensee of the Owner and not a tenant; and that he (she) is not acquiring any interest in the Property.
27. The Guest(s) acknowledges and understands that this reservation is only for the number of adults and children listed below.
ALL GUESTS OVER AGE 21 MUST SIGN BELOW. THE ONLY GUEST(S) PERMITTED TO OCCUPY THE PROPERTY ARE THOSE WHO’S NAME APPEAR BELOW.
IF AN ADULT IS SIGNING FOR UNDERAGE PERSONS, BUT WILL NOT BE OCCUPYING PROPERTY ALONG WITH THE UNDERAGE PERSONS, THIS GUEST LICENSE AGREEMENT IS NULL AND VOID AND WILL BE TERMINATED AND SHALL RESULT IN FORFEITURE OF ALL SUMS PAID.
